Several sources close to the investigation told Fox San Antonio that Nichol Olsen’s phone records show the mother made five calls just after 11 p.m. on the night of the incident.

The first call was made to Wheeler’s mother at 11:09 p.m., which we’re told was not answered. Then four separate calls were made to 911. The first call was at 11:10 pm, followed by two calls at 11:11 p.m. A final call was made at 11:12 pm. Three of the calls did not connect, but show up on Olsen’s phone record. Only one of the calls connected to the 911 system.

I'm guessing he went off and she frantically made the phone calls. He's rich, lawyered up, and suppressed the media.

I followed this one and sleuthed it up like crazy. First let me say that I think this guy is a scumbag because that’s what Nichol was attracted to. But I don’t think he’d kill her daughters.

She was a very troubled woman. I think it’s entirely possible that she murder-suicided out of pure spite and desperation.

On the surface it looks one way. But if you dig deep, there is a possibility that she really did do it.

Women DO kill their children for getting in the way. They DO kill their children out of spite.

Of course it’s possible he killed them, too.

He's been arrested at least 3 or 4 times for DUI. He probably shot them all in a drunk rage. Or shot her kids and then she shot herself.

He had asked her and her criminal brother and her two innocent daughters to move out of his mansion. She was about to lose the big fish she thought she’d hooked. I think it’s totally possible that she flipped.

He wasn’t home when it happened. There was something about the daughter texting her friend but I forget what it was. Gonna try to find it.

There were photos of her with dead animals when she went hunting with him. She did not look comfortable with the guns and the dead animals. But I guess she was trying to participate in something he enjoyed. There was also a video of him in a room with her family, and he didn’t look comfortable with a bunch of brown people. It was doomed no matter what.

R8, what do you think about the 5 911 calls from her phone? All around 11:11 AM? Like she was frantically trying to get them to connect. Maybe the cell reception was spotty out there on the city on the edge of San Antonio.

Could he have staged the murders? Why won't they release the coroner's report? Nancy Grace dropped it pretty quickly. We got no idiot Chris Watts confession as he lawyered up. He's from an incredibly rich family.

R11 She had a whole bunch of friends. She was social enough to find another guy. He's not such a great catch, younger and kind of an asshole. She hadn't shot herself the last two times the divorce happened.

She had child support and alimony. She would have been fine with out him. All her friends and family said knowing her, she couldn't have done it.

I'm guessing it's the drunk who gets arrested on the regular for DUIs.

A second lawsuit has been filed against a former Bexar County resident whose girlfriend and her two daughters were found shot to death in his home two years ago.

Carlos Montez Jr. of San Antonio, the father of Clark High School sophomore and cheerleader Alexa Denice Montez, 16, has sued Charles Edward Wheeler, 33, accusing him of gross negligence and seeking wrongful death, survival and exemplary damages of more than $1 million.

Alexa Montez was found dead with her mother, Nichol Leila Olsen, 37, and her sister, 10-year-old London Bribiescas, at Wheeler’s home in the Anaqua Springs Ranch subdivision near Leon Springs on the morning of Jan. 10, 2019. Wheeler called 911 around 9 a.m. to report the deaths.

He told investigators he’d left the previous night following an argument with Olsen and went to stay with his parents.

The Bexar County Medical Examiner’s Office ruled Olsen’s death a suicide and her daughters’ deaths as homicides, but the Bexar County Sheriff’s Office is still investigating. No criminal charges have been filed.

The suit, filed Jan. 11, is the second lawsuit attempting to blame Wheeler for the deaths by accusing him of allowing Olsen to get access to a gun he kept in a bedside table.

Wheeler sold the home and moved to Austin. His attorneys have said he had nothing to do with the deaths and have repeatedly called on Bexar County Sheriff Javier Salazar to publicly clear his name.

Wheeler has always declined to comment and requested privacy.

That lawsuit also seeks more than $1 million in damages

The latest lawsuit, like the first, accuses Wheeler of leaving his home without taking action to protect the children or call authorities while knowing there was an unsecured gun at the residence.

It cites Wheeler’s text messages to others, in which he claimed that Olsen was acting “really strange” and that she had “been on some kind of pills.” The suit contends that Wheeler admitted to leaving his $1 million home knowing that Olsen “was in a highly emotional state of mind from their argument” and knowing she had immediate access to his gun or guns. Wheeler routinely kept a loaded handgun beside the couple’s bed, it states.

“On the night of the incident in question, (Wheeler) knew that Nichol Olsen was acting irregularly and was not in the right state of mind,” the lawsuit states, referring to Wheeler’s communications with Olsen’s brother and with Alexa Montez, the plaintiff’s daughter.

“Wheeler knew Olsen’s behavior was escalating, was erratic and highly emotional and was potentially threatening and/or could lead to actual violence,” the lawsuit states.

The lawsuit claims Wheeler “knew or had reason to know that the girls were in trouble” and that he sent multiple text messages to Olsen’s brother, Justin Olsen, starting at 11:31 p.m. that night, which provided evidence of “an escalating situation and need to take reasonable measures.”

According to the lawsuit, Wheeler’s text messages asked Justin Olsen to check on his sister, stating she had been acting “really strange” and that she had been “on some kind of pills.” Justin Olsen responded, telling Wheeler that his sister didn’t answer his calls.

Whether Nichol Olsen was taking any medication hasn’t been publicly revealed. The autopsy and toxicology reports for her and her daughters haven’t been released because of the ongoing sheriff’s office investigation.

Possibility: He does the murders around 11:15 after her 911 calls. 15 minutes later he texts her brother to stage the scene, make it look like she shot herself, and have an alibi. Then he leaves.

But can't they determine his location when he texted the brother? If he was already far enough away from the house it might prove he had to have left before the 911 calls. The father's lawsuit suggests that he believes his daughter was guilty.

Sounds like the authorities had a lot of questions last year and weren't able to get new information, so they've just gone with the medical examiner's ruling as a default.

You just don't see cases like this where the mom shoots her teen daughters then herself where there weren't some warning signs beforehand.
