There's every reason to believe the Ellis installation, if it happens -- and I don't think it will -- would be null and void because the position is very specifically meant to be chosen by nonpartisan means. We've known for months that this was a partisan, political, White House decision, and it should be easy for Biden's admin to appeal Ellis's hiring to the general counsel of the Department of Defense. That counsel chooses the person hired for the role, and they probably won't agree to Ellis, but if they do or if Ellis is installed anyway, removing him should be trivial.
