Use the 14th Amendment to ban Trump’s second term
Impeaching Trump after he leaves office will allow Congress to ban him from running again, but will require 2/3rds of the Senate to convict him first
Section 3 of the 14th Amendment bans persons who have sworn an oath to the Constitution and then engaged in insurrection from holding federal office. The statute to implement Section 3 is no longer in effect, but Congress could adopt new procedures.
The procedures could require a simple majority for Congress to determine that the section applies.
Thus they could ban Trump from running for a second term without needing 2/3rds of the Senate.

He's already been impeached. Stop using "impeached" when you mean convicted/removed.

Ain't happening, and he won't be convicted in the impeachment trial either.
The numbers just aren't there, especially if they start the trial on Wednesday.
Maybe wait for 3 months to uncover additional Trump & Company wrongdoings (with the added bonus of letting Trump twist in the wind for another 90 days).

Stop assuming that everyone using the word “impeach” has made that error, R2. Read my post and it’s clear I did not.

R1–Nancy can’t do it now. Even if McConnell agreed to rush the implementation legislation through, Trump would veto it. It would have to wait until Biden is President.

R5, that was part of the Article of Impeachment.
You think I’m stupid?

Pelosi has already said congress will use the 14th Amendment to ban him. She's just waiting for Kamala to be seated just in case.

So when do we start this 14th Amendment thing? There really is no time to lose. 2022 is almost upon us and so is 2024.
