They do a decent job of trying to explain Ivana's past on her Wikipedia page - however, I'm not sure how much can be believed.

She was a talented skiier - and I do believe she was on the junior team, but no way was she on the Olympic team. She was involved with quite a few skiiers, including the one that got her to move to Montreal.

It says she modeled for Eaton's and did some gigs related to the 76 Montreal Olympics - which is sort of believable. And that led to a trip to NYC in 76 where she met Donald.

What I do know about Trump is that a good friend's father played little league with him in Queens. EVERYONE hated him - he was an asshole at age 9. Hi, r35 here. I wrote a memo on spousal communication privilege when I was a law clerk. And I have been a prosecutor analyzing cases involving married couples as suspects. I do seem to be arguing with people who learned procedure by watching TV, though, r110.

There are two privileges that affect spouses in US trial law: testimonial privilege and spousal communications.

Testimonial privilege: Generally, a non-defendant spouse cannot be compelled to testify against his/her spouse in court. Exceptions have been carved out to enable prosecution of spousal abuse and child abuse. This privilege does not survive marriage. So, if a wife saw her husband load a shotgun and put it in the trunk of his car, she could testify to that in court. She could not be forced to so testify, unless the marriage ended.

Spousal communications: Communications between spouses are presumed to be privileged. Privilege can be defeated, e.g., by showing a third party was present or that the spouses were communicating in a criminal conspiracy to defraud. So, if a husband confessed to his wife that he murdered someone with a shotgun, and the wife tried to testify to that effect, the husband would assert privilege. The prosecutor would have to argue to defeat that privilege and good luck with that.

OK, R128, I do have a legal background here. Depending on the state (or whether it's federal), the law varies as to who is the "holder" of the privilege. In some states, the Donald Trump person would be the holder and could stop the wife from testifying (with limitations on the scope). In some states, the wife would be the holder of the privilege and could choose whether or not she wanted to testify.

The policy behind the privilege is to promote intact marriages. One reason for making the Marla person the holder (decider) of the privilege is that if Marla wants to testify against Donald, the marriage is no longer intact anyway, let her testify.

And NDA (in rudimentary terms) is an agreement not to talk badly about someone.

Spousal Privilege is something a spouse can choose to assert (key word) in a COURT CASE. A spouse can always testify against the other spouse if they want in a court case. But if they want, they can assert spousal privilege and they don't have to testify against their spouse for things that happened during the time of their marriage. It is something the person decides. It's not something the other spouse allows/decides. One spouse doesn't get to decide that other spouse they can't testify against them

But spousal privilege isn't even relevant in the donald and marla situation. There's is totally about an NDA. It's a basic contract. She signed it in exchange for money. She signed that she will not talk negatively about him. The minute she talks badly about him, he can sue her for violating it. It's an often forgotten tidbit about Trump. In the 80s and a bit the 90s, everyone in NY knew Trump was a carnival barker but he was not without charm.
