Rushrooke then asked for permission to appeal the ruling, and was denied that, too. Technically, Rushbrooke can go up to the Court of Appeals, anyway, but it would be surprising if the Court of Appeals found his arguments any more persuasive than the lower Court did, so he'd risk getting the same result and spending a great deal of his client's money, and/or piss off the judge in the case.

However, Rushbrooke might also feel it worth the risk to keep his client, who is apparently going to take the stand, from being cross-examined by Antony White about the book, and reading off passages one by one (such as, e.g., how Scobie knew about the fracas over the tiara and what Harry said to his Gran if Meghan didn't share it, and how the authors were able to "review" Meghan's texts to Harry - also referenced in the book).

So Meghan changed lawyers and still lost another round. If this ruling isn't successfully appealed, she can look forward to exactly that sort of cross-examination.
