B) a group of rowdy people bumped into him, and knocked him and the baby out?

The photo of the window makes it easier for me to understand than the angle from the video. The window is a ways in front of the railing, so he's not actually leaning out of it to where it would be obvious there's no glass.

I think the cruise line put pressure on the government to press charges in hopes of the family dropping their suit.

Like, make this situation look better for us, or we take our ship and business to another port.

There's no reason to have open windows that high up where any yahoo can reach them. You can't assume people will be watching their children or won't get into a fight with their fiancee and jump over board.

They are negligent for not having glass go up higher. I do not believe a normally doting grandfather would throw away everything for a payout.

I think that's what bugs me most--the grandfather didn't take a breathalyzer and didn't submit to questioning. In any normal investigation, that would not be acceptable. I truly believe it was an accident, and I also believe the grandfather knew he fucked up. Yes there was an open window. In no way should that child have been near it, and the video doesn't lie--that man picked up his grandchild and held her out the window for quite a while. He knew there was no glass, he just didn't imagine he would drop her.

The baby was dropped by her irresponsible grandfather who stupidly held her out an open window.

I would have sympathy for the family if they weren't suing the cruise ship to score a financial windfall from the tragedy. Now, I see them as money grubbing.I hope the cruise line doesn't settle.

The problem with having no windows that open is that it becomes very stuffy and smells are hard to get rid of. Typically, hotels don’t have windows that open, at the most they crack and inch or two and that’s it. Some places, you can’t open them at all, thanks to idiots like this.

I can’t imagine why anyone would want to travel on a cruise ship with no ventilation. It would be horrible. Just because some homicidal grandpa decides to off his granddaughter, why should everyone else suffer? Do you really think it would be a selling point to advertise, “welcome to our cruise ship, you will be sealed in and never smell the sea air or be able to take a breath of fresh air for days on end!” Might as well stay in a landlocked hotel then.

People have no concern for other people any more, they just do whatever the hell they want and fuck everybody else.

The answer is probably to ban anyone under ten or something. Which wouldn’t be unreasonable, considering how people constantly fling themselves overboard on those ships at the slightest opportunity. Maybe they should ban anyone under 500 pounds, since they couldn’t be easily lifted and flung out the windows or over the rail.

I consider open windows on cruise ships to be in line with lanais/balconies. Every vacation home has a lanai. Is that irresponsible? Every responsible parent not only doesn’t dangle a 2 year old over the railing, they’re probably anal about making sure the kids don’t go out on the balcony. I know we were when we vacationed with our young nieces. There is no way that guy thought there wasn’t glass there. No way.

If you notice, he takes the kid to the far end of the room, bypassing lots of spaces where there’s glass. Why? It looks like he leaned out the window to check what was down there, then after he found out what was down there, picked up the kid and leaned completely over the window. R96, we’re constantly hearing about people “falling overboard,” “mysteriously disappeared,” “apparent suicide” and so forth on ships. Some are suspected to be murders, but there’s never any proof. A lot of them are newlyweds, which makes it even more suspicious.

Who gets on a ship on their honeymoon with the intention of committing suicide? If their spouse was beating them, there must be security all over. And people are supposed to be happy on their honeymoons, not jumping to their deaths. A lot of them are probably murders for the life insurance.

There is no way, drunk or sober, that grandpa couldn't see and FEEL that the window was open. Breeze in his face, etc. I have no doubt he was drunk. And I have no idea whether it was deliberate or accidental –But the entire tragedy was his fault. The open window was toddler-proof; high up, and with a railing in front of it to boot. Grandpa lifted her up and over the railing! To argue that the ship was negligent for having that window open is beyond ridiculous. It could just as easily happened on one of the stateroom balconies. Would someone argue that the balconies should be totally glassed-in for safety?

One last point. The child supposedly loved to bang on glass. Is that an activity that any responsible adult would encourage? Glass is notorious for breaking and causing severe injuries. Nah, it's far more likely that the drunk grandpa made bad decisions and immediately after the baby fell, because he was drunk and freaked out, said he was sure he was at a closed window and had no idea how this could have happened. And maybe he even thought he was open, or was in denial.

The family started pushing for "justice" and he never 'fessed up when he should have. That's the problem here. The cruise line also should have shown the footage from the very beginning and let the family quietly withdraw their suit. It never should have gotten to this point.

I read they were also saying he's color blind, and couldn't tell the difference between an open and closed window. The fact that there's a railing a few inches in front of the window would appear to indicate to me that it's there to guard people from getting too close. And the fact that windows aren't open at child level would appear to indicate that the ship doesn't maybe want children to fall through them. I don't know why people are making excuses for someone who showed bad judgment, drunk, color blind or whatever. At a certain point you - and you alone - are responsible for your bad choices. You can't be protected from every single one. I mean, seriously, how about the general rule that you don't dangle babies out open windows?

If you look at the video, it goes like this: 1. Grandpa sticks his own head outside the window, sans baby. 2. Grandpa picks up baby from the floor or somewhere, lifts her, then thrusts baby through open window he already knows is open because he already stuck his own head through the hole. 3. Baby disappears out of sight. 4. Obviously people around became aware of what happened because they’re all moving towards him.

He’s a cop, he was thinking if Step-Grandpa got arrested in PR, it would cost a fortune and he would be stuck there. A big hassle for the whole family. The baby wasn’t worth all that bother. It was out of his jurisdiction so he couldn’t influence anything.

It was a stupid accident. I think the lawsuits and the family's self righteousness are more about having someone else to blame than the money. I can't imagine how hard it must be to really come to terms with something like this, just absolutely horrible. Think about it, if your father killed your child (accident or otherwise,) I'm pretty sure that would just fucking break you. The cruise ship is responsible for the safety of children on board. They have liability. The video pretty much shows the dude did not purposely kill the child. It is not a murder or manslaughter case. There are other families in that area, but it is not safe for families. It sounds like the family did not receive services, and were harassed. They can sue the cruise ship for that too.

It was a dumb thing to do but it was definitely an accident. He goes up to the window and sees the view. He wants to show his granddaughter the view as well. He holds her up assuming he can hang onto her. She either squirms or he loses muscle control for a second and a second is all it takes.

Yes, it’s less sexy than grandpa lobbing the tyke over the side, but it’s the more rational explanation.

A drunken fool dangled a tot out of a window and due to his inebriation, dropped the child. The child subsequently experienced having her skull crushed and her brains spread over the deck below.

The role of "the law" is to prosecute to the full extent of the law the perpetrator whose actions led to the child having her skull crushed. She is the only victim here, and the law represents her and her right for justice.

Lawyer here and I went on at least 2 cruises on that ship so I'm familiar with that deck (I slept in a hammock right there once after too much to drink and my bunkmate was having a fling). Good times. I had lots of sympathy for them till they started with the claim for $$$$$$$$. Grampa made a stupid mistake lifting the kid up. That window is at least 5 feet off the ground. I'm 6'4' and can comfortably lean on it but not over it.

They'd have gotten some cash from the cruise line to shut them up but they got greedy and now I think the cruise line should tell them to go fuck themselves. It was an accident, plain and simple but there's no way a kid could have gotten up over that window ledge without someone lifting them up. All the claims about it being a "kids area" are bullshit. Yes, its a pool deck area where kids play but short of pulling up a chair, no toddler could even see over that railing. The entire all nearby is glass, she could have banged till her heart was content right there.

Sucks but her gene pool clearly wasn't too clear anyway.

Toddlers are squirmy, so drunk or not, that was a horrendous lapse in judgment. Plus she may have been frightened by seeing how high up she was, and started resisting his hold. I also think the lawsuit is the only way the family can live with this. It HAS to be someone else's fault.

I watched the video again. He doesn’t stumble towards the window so how do we know he was drunk? It almost looks like it was on purpose to be honest which is so sick that I can’t even begin to comprehend. Could it be something similar to that munchausen by proxy syndrome where people kill kids for attention or even money? It just seems too dark and planned for him to not know what he was doing. They had a video and it was never leaked til it came up at trial. The public didn’t Overwhelmingly back the airline til the video came out. So the cruise line is playing this smart, not on emotions. Clearly you have no patience.

And you don’t have to be a complete mess to be drunk. The grandpa was a bit tipsy (I get tipsy at family parties all the time), thought the view and breeze was beautiful, and then lifted toddler to experience same bliss.

But maybe he wasn’t drunk. If that’s true it makes grandpa look sinister and that he did this on purpose.

R273, the thing about it that smells fishy is the family does know if he was drunk. Most families would be absolutely hysterical after their baby just died a horrible death. They may have seen the body, or it may have been so dissolved there was nothing to see.

I can’t imagine a parent on earth that would shrug off a baby’s death and seek to shield the murderer. Their actions were as bad, or worse, than his.

Any true crime book writer or cop will tell you, when somebody dies and a family member shrugs their shoulders and acts like it’s no big deal, that person becomes a suspect. And that baby’s very public, very sudden, totally unpredictable death would have caused the worst reaction possible. Even if they were just in shock and unable to speak, that’s not trying to offer legal advice to the killer. Not many people could act so coldly even if they wanted to.

I don’t even have any kids, but when I think of being happy on a cruise, then suddenly someone comes forward and tells me my baby just fell 11 stories to her death, I know that would freak me out. Even an adult stranger doing it on a cruise would horrify me.

But “oh well, at least we can save STEP Grandpa”? No way.

I just watched the video, and it's bizarre that he would pick up that baby and put it in the window like that. He wasn't just raising her a little bit to get a quick look outside, he raised her all the way up and forward to place her on the ledge. That alone took my breath away, even before she fell.

Most rooms on cruise ships have balconies. There is nothing the cruise line can do to stop grandfathers or anyone else from jumping overboard or throwing babies off the ship. I don't know why so many of you find this implausible. Everyone responds differently to trauma, and quite often people fall back on their training and expertise. It's why the military and maritime services drill over and over, so that people aren't paralyzed in an emergency. I know that I become deathly calm and clear-headed in emergencies and grief; I only react emotionally later.

The father is a cop and the mother is a former prosecutor, I read. Their toddler just died horriifically and all they cared about was step gramps not blowing in a breathalizer? Odd priorities.

At one pont in the video, it appears his left hand is braced against the wall, inside the window. So he was holding a human child, 11 stories up, on the palm of one hand?!! Even Michael Jackson used 2 hands to hold that poor baby. THEN they lawyered up and went after $$$ immediately. Kinda makes it seem intentional. Was there life insurance on the baby? Was something else being covered up?

R326 (I'm not 312). I've been through two situations in my life that involved a devastating painful experience along with a kind of "Jesus, take the wheel," circumstance. Though I'm a Peter Pan, where most of my entire life has been frivolous kid stuff, I turned into the adult in the room. I had trouble believing it was me, even while it was going on. Might have been an adrenalin thing. But, while I was experiencing a personal tragedy, that was not foremost in my mind.

I kind of think that, when it comes down to it, we all have a list of tragedies that we might expect in our lives. But difficult situations are a separate, though related, thing. If you're in a burning house with six of your children, you want to rescue as many of them as you can. You don't just give up when you realize you can't save them all.

I really don’t think the grandfather did it on purpose, but the actions of the parents make me pause, for sure. He’s not a blood grandparent, so I don’t get the concern (not being a parent of either the mother or the father). I would be beyond angry at him....but I think, sadly, that the parents soon realized there might be a huge pay day if the cruise line were held liable. On the other hand, to give the parents benefit of the doubt, they may have believed his story at first—that the window was missing. In fact, that was the original story. So I could see why they might support him at first, if they bought his story and thought that a window was mistakenly missing or left open. But after the video, no doubt grandpa knew the window wasn’t there.

R327 But this has nothing to do with the emergency of the dropped girl itself but saving the murderer's ass so that he would be found not guilty in order to pin it on the cruise line for a big payout. They probably knew he had had a couple of drinks. I for some reason think you were more concerned with the tragedy at hand and those that it affected than the culpability of the perpetrator if indeed there was one.

The granddad's lawyer is saying that the video doesn't tell the whole story in that there was a railing in front of the glass panels and that it was hard to see the glass open. But still, the grandad dangled her over the railing so she could pound on the window that turned out to be open.

What amazes me is how her parents and grandparents thought it was ok to let the kid pound on glass/plexiglass for fun. There's a video of the kid pounding on the plexiglass of a hockey rink as she watched her older brother play hockey. Allowing her to do that is stupid, dangerous, and disregards the property of others.

I agree with other posters who have said the granddad was drunk.

R322 When my friend's son was about 4 or 5, I thought it would be fun for him if I did the old flying gag. I laid on my back and had him put his stomach on my extended legs. He was heavier than I thought and he careened off to the side and tumbled onto the floor when my legs buckled. I was horrified. I thought that I could have really injured him. He bounced back up and breathlessly exclaimed, "I'm ok! I'm ok!"

Thank God that I hadn't killed him.

The parents sound really awful. I feel less and less sorry for them. There is nothing more annoying than a screeching toddler being permitted to be destructive and loud, while its parents think it’s cute. If you allow your child to bang on glass, you deserve the fallout. As for Step Drop Pop, I don’t even think the promise of a fat lawsuit would prevent most people from wanting to kill him in the same scenario. I love my father and maybe I could someday forgive him if he stupidly killed my kid. But if it was just my parent’s fuck piece who did it, I’d go straight for their throat.

I still don't see any mascara or lip gloss, R394. Some people have dark eyelashes and it can look like they're wearing mascara I suppose. Anyway, when I asked what was wrong with her face at R390, I meant that she was a very peculiar looking child and I wondered if there was something wrong with her medically or physically. She was a toddler but her face didn't really have the roundness/softness that most children her age have - also, a large head like hers could be the sign of certain medical conditions.

She was a preemie and was said to have medical issues.

Her mother claimed the child had an interest in makeup, many kids do (who here sneaked some lip gloss from Mum or a sister to try?!).

I knew a child with that sort of hair and it was linked to a medical problem/condition.

What is the story about life insurance? Would they pay with no investigation given these circumstances? Whole thing is tragic, of course, but just feels so off somewhow.

It is so cold that the parents aggressively circled the wagons around him immediately. He is not even a relative and he just murdered their baby whilst --playing games-- according to staff on the scene. That and the balls to the wall tacticst o try to squeeze big $ out of the cruise ship do raise the possiblility that it was premeditated. Yet, presumably he would not take a plea as it would torpedo the civil $$$ suit, so is the bereaved mom really protecting a stepfather who did not even raise her or her own civil suit. Step Drop Pop has an acting background and numerous tickets for speeding and failure to wear a seatbelt and a misdemeanor ticket that is usually related to public intoxication in IN. Plus, where he lives he could easily have tix in MI or OH as well. Interestingy, the murderer was the ONLY one who did not request sedation.

The ship has very clear HD video and witnesses both on the scene and on the dock, where a worker ran to find a supervisor upon observing his antics/actions.

His interview with fake tears reminded me of recent chld killers.

Such a disturbing family. With dad a LEO and mom a former prosecutor, lotta likelihood for spaths there. She was a preemie, did she have ongoing SN that made the family reject here? There is a weird vibe to the fact that she sometimes appears to be wearing make up in photos as a young toddler. Kinda Jon Benet-ish.

I really r ewww LLP hope they go after the drunk grandpa with vengeance. Tech that’s the only way they can beat the lawsuit.

And the parents certainly don’t care about drunk grandpa. If they were to win millions from this lawsuit, I bet they’d kick grandpa to the curve the day after. They are only being friendly to him because of the lawsuit.

If there had never been a possibility of this lawsuit, I bet the family would’ve kicked out drunk grandpa one day one. But that didn’t happen cause they knew on day one a lawsuit was possible!
