21-year-old Candace Clark of Hoffman Estates says she’s the victim of a Kim Foxx double standard, and a Cook County Judge agrees.

On April 11, Clark appeared in the Rolling Meadows courtroom of Cook County Judge Marc Martin, facing a single felony count of making a false police report.

Clark is accused of giving an acquaintance access to her bank account and then telling police money had been stolen, something she denies.

According to a transcript obtained by FOX 32, Judge Martin hammered prosecutors, asking, “I’d like to know why Ms. Clark is being treated differently than Jussie Smollett. It’s a disorderly conduct case. A lot less egregious than Mr. Smollett’s case. I have a problem with it.”

Prosecutors were demanding that Clark make full restitution of $2,800 and serve deferred prosecution, something not required of Smollett.

“Ms. Clark is not a movie star, she doesn’t have a high-priced lawyer,” said Judge Martin. “And this smells big time. Your office created this mess. There’s no publicity on this case. Press gets ahold of this; it’ll be the newspaper."

A spokesperson for Kim Foxx says because the case is ongoing, they have no comment.

“I’m not Jussie Smollett,” said Clark. “I wish I was, but it’s OK. I’ll get my justice.”

Clark, who has no previous criminal history, is due back in front of Judge Martin Thursday.

hicago's top prosecutor Kim Foxx has been subpoenaed to appear in court for a hearing over her handling of Empire actor Jussie Smollet's high profile case.

Retired appellate judge Sheila O'Brien subpoenaed Cook County State's Attorney Kim Foxx along with her top deputy Joseph Magats and in a separate document requested that Smollett also appear at the hearing.

O'Brien is pushing for the appointment of a special prosecutor to investigate Foxx's handling of the controversial case.

She says that Foxx's handling of the case was 'plagued with irregularity'.

O'Brien requested that Foxx, Magats, and Smollett produce the original documents used in Smollett's criminal case to 'assure' the public 'that they have not been altered or destroyed and will not be destroyed throughout this case', according to court documents as per the Chicago Sun-Times.

'Foxx’s conflict in this matter is beyond dispute,' O'Brien wrote in the court documents, saying Foxx should have sought the appointment of a special prosecutor.

Foxx's office is also undergoing an independent inspector-general investigation on how she handled the case.

Since the scandal, three members of Foxx's team - including her chief ethics officer and chief spokesman - have left the office.

Foxx says she defends the decision to drop Smollett's charges and welcomes an independent investigation.

Edward Ryan, who operates a private investigation firm in the southwest suburbs, said one of his process servers went to Tchen’s law firm in River North on Wednesday, but she refused to come to the lobby to accept the subpoena.

Ryan said the security guard in the building’s lobby would not let the process server upstairs. The guard called Tchen in her office and “she said she knew about” the subpoena, but refused to come down.

“I don’t know why she’d turn it down. She’ll be served eventually,” Ryan said.

The embattled office — which was supposedly picking up the probe from cops after Smollett’s indictment in the alleged phony race-hate attack — also never even requested the evidence that cops had built their case around, documents released by the Chicago Police Department on Thursday show.

The revelations mark just two more instances where the office straddled ethical lines and broke protocol to pave the way for the actor’s alleged preferential treatment.

Chicago cops say in the papers that shortly after a grand jury handed down a 16-count felony disorderly-conduct indictment against Smollett, they were told by the prosecutor’s office that “they could no longer investigate the crime.”

Law-enforcement sources told The Post on Friday that the directive was highly unusual and that prosecutor’s office ”had no authority” to ask cops to get off the case. But police followed the order.

The cops added that they were told to hand over all of the evidence and items left on their “to do” list to Lanier when asked, according to the massive public-records dump.

That same day, Lanier told the department that she’d “likely” send it a request for the evidence by March 11. She never did, the records show.

The documents also shine a light into how the police department was duped by Foxx’s office into thinking Smollett would be prosecuted for allegedly lying to cops that he was beaten by a pair of Trump-loving white men on a desolate street corner near his house on Jan. 29.

On the same day cops were asked to stop investigating, Lanier told them she felt the case would be “settled” with community service and a $10,000 fine, leading police to finish their final detective report with the words “CLEAR CLOSED ARRESTED PROSECUTION,” under the impression “settled” meant there’d be an acknowledgement of guilt, the papers said.
