Democratic Party files lawsuit alleging Russia, the Trump campaign & WikiLeaks conspired to disrupt the 2016 campaign

The Democratic National Committee filed a multimillion-dollar lawsuit Friday against the Russian government, the Trump campaign and the WikiLeaks organization alleging a far-reaching conspiracy to disrupt the 2016 campaign and tilt the election to Donald Trump.

The complaint, filed in federal district court in Manhattan, alleges that top Trump campaign officials conspired with the Russian government and its military spy agency to hurt Democratic presidential nominee Hillary Clinton and help Trump by hacking the computer networks of the Democratic Party and disseminating stolen material found there.

“During the 2016 presidential campaign, Russia launched an all-out assault on our democracy, and it found a willing and active partner in Donald Trump’s campaign,” DNC Chairman Tom Perez said in a statement.

“This constituted an act of unprecedented treachery: the campaign of a nominee for President of the United States in league with a hostile foreign power to bolster its own chance to win the presidency,” he said.

The case asserts that the Russian hacking campaign — combined with Trump associates’ contacts with Russia and the campaign’s public cheerleading of the hacks — amounted to an illegal conspiracy to interfere in the election that caused serious damage to the Democratic Party.

Suing a foreign country may present legal challenges for the Democrats, in part because other nations have immunity from most U.S. lawsuits. The DNC’s complaint argues Russia is not entitled to the protection because the hack constituted a trespass on the party’s private property.

The lawsuit argues that Russia is not entitled to sovereign immunity in this case because “the DNC claims arise out of Russia’s trespass on to the DNC’s private servers...in order to steal trade secrets and commit economic espionage.”

The lawsuit echoes a similar legal tactic that the Democratic Party used during the Watergate scandal. In 1972, the DNC filed suit against then President Richard Nixon’s reelection committee seeking $1 million in damages for the break-in at Democratic headquarters in the Watergate building.

We live in a global economy that requires a global exchange of ideas.

You can't hold an election in an "America Only" vacuum.

Apart from everything, every US election is swayed by the millions of people who are not Americans but who are here illegally. Their demands have a direct influence of all our elections even though they are not Americans. Russian influence takes a back seat to Mexican influence in US elections.

I posted a similar idea I had months ago on one of the other political threads.

My idea was for some brilliant, ambitious attorney to file a class action suit. Something like The American People Vs. The United States of America having to do with the fact that our election was not fair and just, and various instances could be brought up including rigging the election booths, hacking the voting tallies,, and just plain interference by the Russians infiltrating our Media, I also cited the Republican Party for giving us a poorly vetted and brazenly dishonest candidate in Donald Trump.

I doubt anything will come of this, but still glad there is at least some kind of attempt.

Some of you seem to have forgotten this is a civil suit. For example R8. A civil suit doesn't involve a state agency investigation. Also it really doesn't matter what the US government has done. It's about trespass on private property. . Considering Trump isn't named in the suit why do you think his taxes can be subpoenaed?

Also I don't think this is a case of the DNC finally getting some balls. It's not like this information was available the day after the election, or even the day after the inauguration. It takes time and a hell of a lot of work.

MSNBC just said something very important. This is a civil lawsuit so it means that even if Trump were to disband the special council, this case would still be able to use whatever discoveries and evidence we have thus far and still go for more from Trump and everyone involved in the hacking and collusion of the 2016 elections.

This lawsuit is just a hybrid of the Mueller Russian prob, and it's a clear warning to Trump that firing Mueller will not make this go away.

It's both, R206. At the national level, they can focus on things like Russia, corruption, his Cabinet picks, etc., while at the local level the candidates should be running mostly on local issues. That's mostly what Democratic candidates have been doing for the past year and a half, which is just one of the reasons they've had so much success.

Honestly, I'm skeptical that the lawsuit will make it to trial but even if it doesn't I'm fine with it. The DNC just took a horrible week for Trump and made it just a bit worse. And the list of people they are going after deserve some added heat. And it riles up the base and lets them know that the Democratic Party can fight. If nothing else, a big "fuck you" to that list of plaintiffs is definitely worth the low cost of pursuing this.

The downside? Nothing, really. Despite the drama queens above, the worst that is likely to happen is that a judge decides there are standing issues or insufficient evidence to take to trial. This isn't something that is being handled by the local Democratic candidates, so it's not going to block their focus on the mid-term elections. The only people who are going to hate this are the people who wouldn't vote for Democrats, anyway, so no loss there. And it's not like this is going to consume massive amounts of resources or time. So no reason to not go for it.

One thing that I hadn't been aware of and that hasn't been mentioned on this thread is that the DNC had to file the case now. Otherwise, the statute of limitations would have run out. Claims under the CFAA and SCA have to be brought within two years of the date of the offense or the date of the discovery.

The DNC successfully sued Nixon after the Watergate break in, and were widely derided in the media at first. Then in promoted the investigation that ultimately led to Nixon's resignation, so the pundits stopped laughing. The DNC is now represented by the very successful Cohen Milstein, his firm has a lot of experience suing foreign governments using FSIA and he personally has done some huge data breach cases. Very different than the clown car show of Trump's team.

The DNC's only mistake was waiting so long, but it looks like they got in just in time under the SOL.

first of all the Democrats are bringing this lawsuit because they know the strategic value of it. Everyone in congress who has access to the classified intelligence knows DT conspired with Putin to take the US Presidency. They can't talk about it publicly, but that certain knowledge fuels the decision to bring the lawsuit.

The notion that Meuller has found nothing because the investigation hasn't announced its findings is ludicrous but some people will take their assurances where they can get them regardless of the cost to the truth.

Hillary's legacy will outlive that of many presidents, especially that of Bush jr and Obama. Not only because she was the first female ever elected president, but because there was a coup to denied her the chance to take the presidency.

Trump's legacy will also be notable, but for all the wrong reasons. His name will live in infamy, and in the long run he will eclipsed the Bushes and Obama too, again for all the wrong reasons.

Bernie Sanders will be a very small footnote in history. His name will die out among the giants that will come out of this tumultuous period in History.

Yes, that would be amazing. Hillary has led a life of bridging gaps and trying to bring people together - that is the negotiator/lawyer in her I think. For that reason I can see she would not want that particular job. Maybe if the election of POS was then declared unconstitutional, and she could be installed that is one thing that she would agree to.

We really need to see the Nunes, Gowdy’s, wingnut teabaggers, even Miss Lindsey go down with the Russian/NRA Money ties. But with a BLUEWAVE it is all possible.

As for Nancy Pelosi - she knows what so many refuse to see- she is the ADULT in the room. If impeachment 2/3rds of Congress & Senate Is not 100% assured you do not ever even consider it. Most especially that is not tried when the other party owns BOTH HOUSES. A wounded Trump is a far far more dangerous, mentally ill unstable man. His idiot kids would be too.
