While NDA can't be used to cover criminal actions, those would be pursued by a DA or grand jury. The victim would have to file a complaint and have the DA believe it enough to seek evidence of an arrest. Most NDA also require the signed party give the person notice if a subpoena for testimony is issued so they can fight the subpoena.
