How come the new movie "Rush" can be called "Rush"...

even though there already was a Rush with Jennifer Jason Leigh, yet The Butler had to be Lee Daniel's The Butler?

since Warner brothers had copyrighted the title it was up to them to decide if Harvey Weinstein could use it. Harvey even went to the movie Board of Directors and they turned him down.

Wrong. R2 has it right. Studios always have the option to do what Warners did to Weinstein, but they don't bother as ultimately it wouldn't pass muster legally. But since the film was about to come out, time was on Warners' side and they decided to make trouble.

The PRECIOUS title was a last-minute change from PUSH (the title of the original novel) as there had been another film earlier the same year called PUSH (a sci-fi POS with Chris Evans and Dakota Fanning).
