I hate how they word the headline, as if it was the train's fault. Were they actually surprised to find a train of all things was actually using the tracks? Trains don't exactly sneak up on you. How does this happen?

It was clearly the driver's fault. He went across the tracks when traffic would not allow him to clear the tracks. He should be charged with negligent homicide.

Especially since there were crossing gates.
You're right, they always write the headlines backward; it's never dumbfuck hits train.
A neighbor was an engineer with the Union Pacific, and during his career he hit two cars. He said you never forget the occupants looking up at the train an instant before you hit.

I almost was hit by a train once. I was young and a fairly new driver. I was waiting for a train to cross the road in one direction, and unaware of one approaching on the track behind it from the opposite direction. I pulled out as soon as I saw the caboose from the first train...and suddenly the lights from the oncoming train were lighting up the inside of my VW bug.
Since I was already directly in front of the train, I stomped on the gas, and I made it across safely. But I was damned lucky I lived.
But even at that young age I was smarter than anyone in TX, apparently.

I saw the statistics once, and something like 25% of the accidents are probable suicides, but the truly amazing number was that about 15% of the people manage to drive right into the side of the train.
