Attorney Claims Colton Haynes Photos Are ''Pornography''

A photo spread featured in a now-defunct gay interest magazine five years ago has caught up to one of the stars of MTV's new series "Teen Wolf."

Colton Haynes, who plays Jackson in the series set to premiere next month, has sought the help of California attorney Bryan J. Freedman of Freedman & Taitelman LLP to remove several pictures from various websites in recent weeks that depict Haynes shirtless and kissing another boy.

In a letter to at least one site, Freedman described the photos as "private, obscene, lewd and pornographic," and demanded the photos be removed immediately or the website could face litigation from Haynes. The pictures have actually been making their round through the Internet for the last year, at least since Haynes was cast in the short-lived horror-inspired series "The Gates," which aired last summer on ABC.

However, postings of those pictures had been inexplicably disappearing in recent months, but not at several news outlets, including the gay-themed science-fiction site DoorQ.

Jody Wheeler, the owner of DoorQ, said he received a cease and desist from Freedman this week demanding the removal of the pictures. In this letter, Freedman said one of the pictures showed Haynes "partially or possibly fully nude in a jacuzzi engaging in sexual content with another individual." Freedman described this particular photo as "sordid, grossly perverted and can only appeal to those with the most prurient of interests."

"That you would publicize such content is disturbing," Freedman continued. "Your election to continue doing so is criminal."

The photos, however, could likely not be described as "private," especially since they all appeared in the March 2006 issue of XY magazine. Two photos in that spread showed Haynes and another male in a jacuzzi, both shirtless and both kissing each other.

However, Freedman continues those claims in his letter, which was dated May 31.

"The public disclosure of, and wrongful intrusion into one's private activities, constitutes an invasion of privacy and is actionable in most jurisdictions, including California," Freedman said. DoorQ is based in California. "Your public disclosure of these private photographs violate Hayne's privacy rights as such conduct qualifies as a public disclosure of a private fact which would be offensive and objectionable to the reasonable person."

The attorney does point out that Haynes was a minor at the time the photos were taken (the actor is 22 now), and has made an added claim to what he called the "pornographic" nature of the photo.

Yet, Haynes is no stranger to risque modeling. He was an Abercrombie & Fitch model -- whose catalogs are known for its excessive skin exposure from its models -- and also did work for Ralph Lauren and Kira Plastitina.

Wheeler has responded with a post of his own at DoorQ saying the pictures aren't private, and are hardly pornographic.

"These pictures, while showing Mr. Haynes goofing off [with], even kidding, another guy, there's nothing more risque to them than your average Abercrombie & Fitch advert [or] TV shows on MTV," Wheeler said.

When reached by telephone Wednesday evening, Freedman described the letter as a "litigation matter," but said he would provide a response at a later time. He has yet to issue that response.

A request for comment from Haynes' publicist is also pending return.

Once a story like this gets out, the photos will be all over the place. It happened with Jakey just two weeks ago. It goes back a whole decade to the Brewer twins when their lawyer told Billy what'shisface in a speedo, to remove their erotic pics from his website. %0D %0D If you do a google image search on Colton Haynes you'll get plenty of thumbnails of the hottub kissing pic but the full-size versions have been removed from most of the pages. He does some very erotic posing and trying to come up with a squeaky clean image isn't going to work very well as long as his erotic poses are still floating around.

Amazing. When this thread was started you could still find pics from the shoot by doing a Google photo search, but they are disappearing. Most of the links that still exist are stinky, leading to "photo removed at request of copyright holder" or similar. Glad I downloaded them before. I have seen about 50 pics from the XY shoots (Colton was on at least two covers). It seems the photographer (or perhaps someone else connected with it) let a lot of unpublished photos out of the box.

Doesn't this just smell like another PR stunt to get this guy's name out there in advance of his TV debut? I mean, who the hell had even heard of this actor before these stupid letters went out?%0D %0D And yeah, apparently some sites may actually take the photographs down, but anybody with some knowledge of the law reading those letters would just laugh. The claims are so ridiculous (and poorly written) as to seem like a parody - like, the lawyer claims publicizing the contents of the cease and desist letters he's sending would be a violation of the Copyright Act? Huh?%0D %0D The fact that these letters are so poorly written and stupid just makes me think it's a fake controversy to drum up interest. Didn't MTV also face a much-publicized "controversy" surrounding whether their version of "Skins" would constitute underage porn? Maybe MTV's PR department's new tactic for getting people interested in shows is to raise a ruckus about their actors doing porn (another example I just thought of - didn't they send out letters asking people to take down pictures of that MTV Real World actor doing gay porn? Sounds similar to this - sending cease and desist letters to publicize the fact that pictures are out there). If so, it seems rather crass and pathetic of their PR department.

I got an interesting letter in the email yesterday from someone who claims to be a Bryan J. Freedman, an attorney who says he represents upcoming actor Colton Haynes, late of THE GATES TV series and currently of MTV%E2%80%99s new TEEN WOLF scripted, which debuts this weekend. What was interesting %E2%80%94 and concerning %E2%80%94 was that the letter said that doorQ.com had posted private, pornographic pictures of Mr. Haynes!

The letter said:

I am contacting you regarding [doorQ.com's]%E2%80%A6postings of multiple private, obscene, lewd and pornographic photographs of my client, privately taken%E2%80%A6depicting my client%E2%80%A6 partially or possibly completely nude, engaging in or simulating sexual conduct, in most instances with other individuals.

Ack, right? The letter went on to say that:

%E2%80%A6the photographs depict my client partially or possibly fully nude in a Jacuzzi engaging in sexual content with another individual. the Site%E2%80%99s publication of what are clearly private photographs depicting sexual conduct, violate Haynes%E2%80%99 right to privacy%E2%80%A6. Your public disclosure of these private photographs violate Hayne%E2%80%99s privacy rights as such conduct qualifies as a (1) public disclosure (2) of a private fact (3) which would be of offensive and objectionable to the reasonable person. While we can only speculate as to where you received these private photographs from, rest assured that you posted them without Haynes%E2%80%99 consent or knowledge%E2%80%A6

Color me astonished that I%E2%80%99d grabbed private pictures of Colton Haynes engaging in sexual conduct with another guy from an Internet / Google link! I didn%E2%80%99t know that any private pics of Mr. Haynes engaging in sex with another guy were out there on the web! And, while I%E2%80%99m sure that someone who had private, pornographic pics of Colton Haynes with another guy might have run over to TMZ or The Smoking Gun to sell such private pictures of Mr. Haynes having sex with another guy to them, I wouldn%E2%80%99t. I took them down! We don%E2%80%99t do porn here at doorQ.com.

What really puzzled me was that I could have sworn I%E2%80%99d seen photos similar to the ones that attorney Bryan J. Freedman said were private pictures of Colton Haynes having sex with another guy, but that these ones were published many years ago, as a non-pornographic, photo-essay in the (now-defunct-but-then) popular and very public, nationwide magazine for gay youth, XY Magazine. I%E2%80%99d need to find back issues,though, to clear that nagging feeling up%E2%80%A6

And wouldn%E2%80%99t you know it, I did.

In March of 2006, XY Magazine published a photo essay titled %E2%80%9CDont Mess With Texas%E2%80%9D in the %E2%80%9CShocking%E2%80%9D issue. Some of the pages of that issue are reproduced below. It%E2%80%99s not the full magazine, but under First Amendment protections of Fair Use, it is enough to see that the physical magazine existed, what kinds of articles it ran (news! editorials! lifestyle pieces! photo-essays!) and that it did have the photos %E2%80%94 and cover! %E2%80%94 that I remembered.

The multi-part essay depicted a young Mr. Haynes%E2%80%A6 well, a %E2%80%9CColton%E2%80%9D according the mag%E2%80%A6 in non-pornographic, fun and, perhaps, even cheeky exploration of the idea of being %E2%80%9CShocking.%E2%80%9D But that%E2%80%99s about it. XY wasn%E2%80%99t a porn magazine, after all. Nationally distributed, sure. Well known? Of course! But porno? Please.

As you can see, these pictures, while showing Mr. Haynes goofing off %E2%80%93 even kissing %E2%80%93 another guy, are no more risque than your average Abercrombie & Fitch advert, network TV commercial or MTV series%E2%80%A6.except, well, that they%E2%80%99re gay.

Come to think of it, they aren%E2%80%99t any more risque than scenes from the feature film I just produced, JUDAS KISS, staring Charlie David, Sean Paul Lockhart/Brent Corrigan, Timo Descamps and Richard Harmon, playing in film-festivals near you this summer and out on DVD and VOD this fall! Attorney or not, I%E2%80%99m glad the guy who wrote the letter under the name of Mr. Freedman was looking out for Colton Haynes, making sure that private, pornographic pictures of Mr. Haynes would disappear from the web. That%E2%80%99s a valiant service. I%E2%80%99m sure MTV is also glad that this person was heading off bad publicityfor one of their new shows and not creating it. Well, that%E2%80%99s assuming that a)the letter writer is an attorney and b)they spoke to the Viacom legal department. I can also imagine that non-pornographic and quite legal pics of Mr. Haynes are something everyone, attorney or not, can support, as they raise the young actor%E2%80%99s profile and endear him to a great many fans.

As to if the pic that I removed from doorQ.com actually is a private, pornographic picture of Mr. Haynes bares any similarity to the perfectly legal, perfectly public, nationally and internationally distributed pics from the 2006 issue of XY Magazine, samples of which are embedded above, that%E2%80%99s up to a reader to decide. I took down what someone purporting to be Mr. Freedman said was such and image and have replaced them with perfectly legal ones.

One more interesting thing. The letter that I received from someone purporting to be Mr. Freedman and which concerned the matter of private, pornographic pictures of Colton Haynes (since removed from doorQ.com), contained this strange paragraph which said, in part:

This letter is a confidential legal communication and is not for publication. Any publication, dissemination or broadcast of any portion of this letter will constitute a breach of such confidence and violation of the Copyright Act, and you are not authorized to publish this letter in whole or in part.

Really odd statement, no? It%E2%80%99s why I keep thinking that the letter isn%E2%80%99t from an attorney, as basic First Amendment protections and Fair Use precedents are pretty standard things private citizens, journalists and writers freely enjoy. Sure, from time to time we may have to remember they are there, but it%E2%80%99s great to know they are there when you need them. I%E2%80%99d hate to think that bullies could get away with scaring people into submission with a few strokes of a pen.

Anyway, I guess that should bring to this matter of regarding private, pornographic pictures of Colton Haynes kissing another guy and not public, perfectly legal pictures of Colton Haynes modeling and having fun in a photo spread, to a close. Right?!

I don't understand the approach. It would work a great deal better for Colton to claim that the pictures were a modeling job while buying all the publishing and ownership rights from the photographer or magazine and make the websites take off the pictures on the copyright owner's order and let the fangirls of the upcoming actor do the rest (oh, you think ALL pretty actors are gay, he said that the pictures are from a model session and I believe him!).

He should deffo fire that lawyer and get a better one with better advice and rethoric skills.

I don't judge ambitious guys like Colton who want to make a living or get famous, but I think he and his handlers are doing it all wrong. This will leave a bad aftertaste and people will bring that up on every single thread or mention about him in a negative kind of way.

Does MTV really have that in mind as promotion for Teen Wolf (a show I was really looking forward to until now)?
