ARREST WARRANT out for Dave Foley in CANADA!
Because he is a dead-beat dad. Hasn't paid any child support for his two kids from his first marriage.
He was recently ordered by an Ontario Family Court judge to pay his first wife, Tabatha Southey, and two teenage sons more than he has been able to earn.
"I'm happy to give away half my money, that would be great," said Foley. "But I'm literally obligated to give away 400 per cent of my income, or otherwise go to jail.
"The judge even said, if I was paralyzed from the neck down, I would still be responsible for having to earn a million dollars a year."
While he was re-married to American actress Chrissy Guerrero a few years later, and the couple had a daughter in 2003, Foley said the strain of having to pay spousal and child support for his first marriage contributed to the recent dissolution of the second one.
Foley explained the latest ruling stated he remains on the hook to Southey whether or not he is able to earn the money, and whether or not he is alive.
So, for the time being, Foley has planned to hunker down in Los Angeles. Enforcement measures could include 180 days in jail.
"I don't think I would take to jail well," he said.

[quote] Child Support Enforcement Worker here: he can go to court and get his CS order modified to reflect his current earnings.%0D %0D Not necessarily. I know a guy who literally works day and night because he couldn't get his support payments reduced. He sometimes leaves his 12 hour night shift job at 8 am and arrives at his second job at 9 am and pulls an eight hour shift catches a few hours sleep and returns to the 8p-8a job.%0D %0D The reason? He made a lot more money in the past, before the tech recession hit. He now works as a nurse's aide because it's the only work he can get. In my area, men were known to to deliberately quit their jobs and get lower paying jobs just to stiff their child support payments (they would then work off the books at a second job and keep the cash).%0D %0D The guy went to court and showed the judge he wasn't making anything near what he used to make and the judge, despite being offered proof of wages, would not reduce the support payments.%0D %0D His ex-wife runs to court anytime he is late in making the full payment. Why? Because he cheated on her during the marriage and this is her way of getting back at him. She knows he can't afford the payments. She also makes it difficult for him to have weekend custody of the kid. He can't afford rent. He moved into his mother's two bedroom apartment and when the daughter visited, she slept on a pull out sofa. The ex-wife said "oh no you don't," and got the court to order that the daughter needs to sleep in a bed in a bedroom, or she cannot stay over.%0D %0D The whole situation is bizarre on so many levels. He was a total asshole for cheating on his wife (and then telling her about it after the affair was over, because he "felt he needed to be honest with her"), but it was a one-time thing. Now he is paying for it with years and years of financial harrassment and court costs. So both he and his ex-wife are assholes.

R25 that is just not true. All judges appointed to the Superior Court of Ontario Family Division are lawyers. One can opt to go through mediation where a mediator may or may not be a lawyer. A judge still sanctions the mediated settlement. You are correct that a lot of the lawyers appointed are political cronies but they must be lawyers to sit on the bench as judges. Only justices of the peace can be lay people.

It's the court system. It's not like he gets a fucking choice. He is breaking the law, period. If he didn't want to support his children, he should never have married and fathered those kids. If he thinks it's a completely impossible situation, he can take it to court and do things the legal way. In the meantime, he should obey the law and pay the fuck up and not abandon his children. As for being blatantly anti-male, that's bullshit. You just can't bring children into the world and then not support them and a lot of men think that they can walk away and be free.

What does "supporting his children" mean to you? How can he pay up when they're asking for 4 times the amount of money than he actually makes? He's given the world a lot with his comedy and the man needs kind words and people in his corner right now, so let's support him. If the court won't allow him to adjust the payments to his current income, then screw them and his greedy ex-wife.%0D %0D The way the courts see it, he has to maintain his family in the style they were accustomed to. You have to see the financial picture of child support as if they were never divorced in the first place. What would he have done if he weren't divorced and his income was reduced? Within the confines of a happy marriage, he would have dipped into savings or gotten a better steadier job to keep paying the mortgage, boat, summer house etc. If that wasn't panning out, he'd start to sell assets, BEFORE requesting some sort of sacrifice from the family members. %0D %0D But the last thing he would have done would be to stop providing for his children. The last resort would have been to switch the kids to public school and tell them we need to tighten our belts. I think the courts see it the same way. Your very last sacrifice is your children.%0D %0D For whatever reason, they don't see Foley as someone who's giving up all other alternatives before claiming he needs to cut down on child support. Not while he's marrying other women and supporting them as well, at least. And THAT IS -- a deadbeat dad. %0D %0D When family providers break free of a marriage, they need to give up everything before they make the children suffer. A doctor can't just walk away in a divorce and say "I hated beiing a doctor, now I'm free to be the artist I always wanted to be." The same thing with a successful Hollywood actor - there are bills still to pay and you go and sell out if you need to.

If when you were married you spent 80% of your income on your household and family, don't think you can walk away and start spending only 50%, so that you can use the other 50% to live happily ever after. You either increase your income (what happens - if gradually - in most typical cases), or live happily ever after on that 20%. %0D %0D Yes, only rich household providers (i.e., those that only need 30% or less of their incomes to keep their home happy) can get divorced and not feel the effects.

According to IMDB, he's been working again. Hopefully he's used some of that income to pay his back child support and get current and stay that way.
It takes some guys a while to realize that child support awards are not payable when they're in the mood. Child support isn't based on the personality of the ex-wife or whether it's convenient for him to visit his children.
To those who said the ex should get a job and support her own children: She was the sole support of her children while this guy was being a deadbeat.
A friend worked for a state support enforcement division and it was her job to track down deadbeats. She was overjoyed when she was able to confiscate the IRS refunds to a deadbeat and his current wife. They had enough money to live on a big boat and travel up and down the Pacific coast to avoid paying support.

R70, after watching that podcast, it sounds like Foley would happily, and does, pay child support. The problem is that the Canadian courts expect him to pay the same amount he could afford when he was on NewsRadio (500k a year) and he simply can't pay that anymore. I saw Dave Foley do a show tonight with a couple of guys from Kids in the Hall. I never saw the show and wasn't familiar with Dave Foley. I googled him after the show and came across the stories about his divorce. After watching the video at R67 I feel for the guy. My mother was a borderline and practically murdered my father during the divorce. She did everything she could to financially bleed him dry. I believe Dave's story about his wife. He's probably not a saint, but she sounds like a piece of work.
Tonight he said he's lost 30 lbs and that he's been sober for a year. He looks a lot better than he used to, from what I saw online. Glad to know he didn't do himself in due to the divorce. The show was great, too.

Where I live, child support is allocated according to a set formula. The incomes of both parties are taken into account, along with the number of children and any special needs they may have, that sort of thing. Nobody cares who was screwing around on the side, or which party comes across nicer, the formula doesn't care about personalities.

If you can't afford them, don't have them. Sorry to whoever this guy is, but there are a number of dads that won't give anything to the mothers, but are then appalled when the courts finally get around to slapping them with a Child Support Order. The mothers have to deal with the child's care 24/7, god forbid that the father, who's living with absolute freedom is forced to take care of his own children.
Next time, ask for joint custody, stay married, or accept the fact that you'll be underpaying for the hours of work your former spouse is taking on to raise YOUR children. He can get the rate lowered, no need to air out the dirty laundry in public.

No, r95 taking care of the children alone isn't fair. Always fighting for joint custody. 1. It saves you from child support. 2. Forces you to spend more time with your children. The kids need to eat and live. If married it's not likely that the husband would spend any less on his children. They are entitled to those funds. If you don't have the dough, go to the courts and get the obligation reduced.

I get you r97. But Kevin F gets a fat check because Britney has the money and her kids shouldn't live like Section 8 recipients just because their mother is too kooky to care for them. She makes over 20 million a year, even locked up in an insane asylum, that child support is nothing in the grand scheme of things. He is raising her children, she is off to her slave labor contract jobs. Their mother is Britney Spears, thus the children should live somewhat an appropriate lifestyle as children of a millionaire celeb. If she took care of them, she wouldn't have to pay Kevin anything. But he takes care of her most valuable possessions, thus he is paid a king's ransom.
