No r3, it doesn't mean he is ineligible to be a Councillor of State as residency isn't a requirement to be listed as a Counsellor of State. Presence in the UK is only necessary in order to perform duties as a Counsellor of State in the monarch's absence. Neither Harry nor Andrew are ever going to be selected to act as Counsellors of State in the monarch's absence anyway but they will still remain listed as Counsellors of State until they are no longer among the first four adults in the line of succession.

R24, the rule is that Counsellors of State have to be in the UK to act as Counsellors of State. There is no rule stating that they have to be domiciled in the UK in order to be listed as a Counsellor of State. If you had any clue what a Counsellor of State actually is then you would understand what I'm saying.

Actually, r39, the Regency Act of 1943 (6 & 7 Geo. 6 c.42) amends the Regency Act of 1937, which created the role of the Counsellors of State. This newer act states that that counsellors of state who were absent from the United Kingdom during the Sovereign's absence would not be listed among the appointments.
Here's what the latest article in The Guardian has to say about the matter:

Taxes in the US are much lower over all than the UK. No matter what MAGA Republicans say about being the highest taxed in the world. It's far from it. His only loss would be he has to buy insurance for healthcare. Which in his income bracket is a drop in the bucket. UK and most 1st world countries are much better at that.

Exactly, r39, Harry formally remains a Counsellor of State, although he will never act as one. The same goes for Andrew. They will both remain Counsellors of State until William's kids are 21. They will simply never be called upon to act as Counsellors of State when Charles is out of the country or otherwise indisposed. Harry's official change of domicile does not mean that he is no longer a Counsellor of State. He remains one until Louis is 21.
The 1937 Act that created the role of Counsellor of State also required that the Counsellor of State not be absent from the UK in order to act as a Counsellor of State. The phrase "domiciled in the UK" does not exist in any of the laws or letters patent relating to the Counsellors of State. In fact, the Counsellors of State Act of 2022, which made both Edward and Anne eligible to act as Counsellors of State simply confirmed that Harry and Andrew will remain Counsellors of State. Not be absent from the UK simply means be present in the country in order to perform the duties that the monarch can't. Legal domicile is irrelevant.

By the way r39, Harry has been a Counsellor of State since he turned 21 in 2005. Andrew has been a Counsellor of State since 1981. In all that time neither of them has ever acted as Counsellor of State, even before their "troubles". The whole Counsellor of State thing is not as significant as some people are trying to make out.
