Will teh gays be happy when SCOTUS hands down it decision June/July?
How do we think SCOTUS will rule on DOMA and Prop 8?
-I think DOMA will be struck
-Prop 8 narrowly ruled to apply to CA only or punted back to State Supreme Court
Result: Marriage in CA only and Federal recognition of married gay couples.
It's starts in a week or so, right?
Just don't expect anything, I feel like it could go either way.
If SCOTUS ruled purely based on Constitutional Law, then there would be no question that DOMA and Prop 8 would be struck down, but they rule according to their own political ideologies irrespective of what the Constitution says, so who knows...
DOMA and Prop 8 will be struck down. Roberts annd Kennedy will side with the majority.
I don't take Roberts and Kennedy for granted, although there is a CHANCE that Kennedy's flexibility could put him in the strike-them-down group, carrying the day. I don't think there will be any compromising. And I would hope that Roberts, as a gay man, would follow his heart and see the civil rights basis of the matter rather than the narrow, distorted, hate-filled-and-covering-it-up "states' rights" bullshit of the Scalia/Alioto/Thomas (spit) wing.
