OK- seriously now- you have a 13 year old kid who has been harassed 'for years' by this guy at recess, but the parents wouldn't do anything? A grown man harassing kids at school wouldn't be something that parents would report? For all the progress, the U.S. is still incredibly homophobic, in this case, in the most institutional way, demonstrated in the awkward "what's really happening here" reaction to the video which boils down to, "is this really an offence?" and the protection of the perpetrator. Though YouTube might claim legal protection rather than moral arbitration, I seriously doubt they have release forms for every person you see on YouTube.
